These Terms of Service ("Terms") govern your access to and use of InstallerDesk, operated by AA Foundry LLC ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
"Service" means the InstallerDesk platform, including the website at installerdesk.com, the application at app.installerdesk.com, APIs, and all related tools and features.
"User" or "you" means any individual or entity that accesses or uses the Service, including shop owners, staff members, and administrators.
"Customer Data" means any data you or your staff enter into the Service about your customers, vehicles, jobs, quotes, invoices, warranties, or other business records.
You must be at least 18 years old and capable of forming a binding contract to use the Service. By using InstallerDesk, you represent that you meet these requirements. If you are using the Service on behalf of a business, you represent that you have the authority to bind that business to these Terms.
To use the Service, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account.
You may create staff accounts with limited permissions. You are responsible for the actions of any staff members who access the Service through your account.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
You retain all ownership rights to your Customer Data. We do not claim any ownership over data you enter into the Service. By using the Service, you grant us a limited license to host, store, process, and display your Customer Data solely to provide and improve the Service.
You are responsible for ensuring that you have the necessary rights and consents to enter your customers' personal information into the Service and to send them notifications via SMS or email.
InstallerDesk sends transactional SMS and email messages to end customers on behalf of shop owners. By providing your mobile number to a shop using InstallerDesk — for example, by submitting a booking request or being added as a customer — you consent to receive SMS messages from that shop related to your services, appointments, quotes, and invoices.
Message frequency: Frequency varies based on your active services. You should expect between 1 and 10 messages per month per active job or quote.
Message and data rates: Standard message and data rates may apply, as determined by your mobile carrier.
Opt-out: You may opt out of SMS at any time by replying STOP to any message. You will receive a confirmation reply and no further messages will be sent to your number. Reply START to resubscribe. Reply HELP for help.
Carriers are not liable: Mobile carriers (including AT&T, Verizon, T-Mobile, and others) are not liable for delayed or undelivered messages.
Supported carriers: SMS is supported on all major U.S. wireless carriers. Message delivery depends on carrier availability and is not guaranteed.

We reserve the right to suspend messaging capabilities if we detect abuse or non-compliance with these requirements.
InstallerDesk is offered on a subscription basis. The pricing, features, and billing terms for each plan are described on our pricing page. By subscribing, you agree to pay the applicable fees.
We may offer a free trial period. At the end of the trial, your account will require a paid subscription to continue using the Service. We will notify you before your trial expires. If you do not subscribe, your account will be downgraded and certain features may become unavailable, but your data will be retained for a reasonable period.
The Service, including its design, code, features, documentation, and branding, is owned by AA Foundry LLC and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or brand elements without our prior written consent.
The Service integrates with third-party providers including, but not limited to, Twilio (SMS), SendGrid (email), and Stripe (payments). Your use of these integrations is subject to the respective third-party terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.
We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of scheduled maintenance.
To the maximum extent permitted by applicable law, AA Foundry LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or related to your use of the Service.
Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, secure, or available at all times.
You agree to indemnify and hold harmless AA Foundry LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
We may suspend or terminate your access to the Service at any time if you violate these Terms or engage in conduct that we reasonably believe is harmful to other users, us, or third parties. Upon termination:

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Miami-Dade County, Florida.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
